By using this website, you represent and warrant that you are at least 18 years
of age. You agree that you are financially responsible for all of your use of
this website (as well as for use of your account or log-in information by

completely responsible for all charges, fees, duties, taxes and assessments
arising out of the use of this website. You agree to comply with all applicable

any necessary updates, modifications and adjustments at any time without prior
notice to product descriptions, warranties and prices, due to errors, product
discontinuation, changing costs, new market conditions or any other factor. All
prices are subject to all applicable sales taxes, handling charges and shipping
charges.
In the event a product is listed at an incorrect price due to typographical
error or error in pricing information received from our suppliers, Monroe County
Flowers.com shall have the right to refuse or cancel any orders placed for
product listed at the incorrect price. Monroe County Flowers.com shall have the
right to refuse or cancel any such orders whether or not the order has been
confirmed and your credit card charged. If your credit card has already been
charged for the purchase and your order is cancelled, Monroe County Flowers.com
shall immediately issue a credit to your credit card account in the amount of
the incorrect price.
Monroe County Flowers.com is NOT a retail store open to the public and subject
to the rules of public accomodation. We are artisans who create designs made
with flowers along with other items. We are not a place of public accommodation
and may refuse your order or other orders for any reason at any time. Your
receipt of an electronic or other form of order confirmation does not signify
Monroe County Flowers.com's acceptance of your order, nor does it constitute
confirmation of our offer to sell. Monroe County Flowers.com reserves the right
at any time after receipt of your order to accept or decline your order for any
reason. Monroe County Flowers.com reserves the right to not send any gift
message that includes profanity, offensive language or hate speech. The sender
will not be notified in this case; the message will be destroyed and the order
may or may not be shipped with no message attached. Monroe County Flowers.com
reserves the right at any time after receipt of your order, without prior notice
to you, to supply less than the quantity you ordered of any item. Monroe County
Flowers.com reserves the right to substitute similar product of equal or greater
value and/or to make color substitutions.
Complimentary floral enclosure
cards to convey your gift message are offered during the ordering
process at no additional charge. Floral enclosure cards are small
cards approximately 2.5" x 3.5" in size. You may enter text you want
to include on the card, but please try to use no more than 25 words,
as the cards are small. If we find it necessary, we may edit the
text you submitted for brevity. We may also delete profanity at our
discretion. Floral enclosure cards have no cash value. Errors,
omissions, misprints, or our failure to include the card at all does
not affect the value of the order and no consideration or price
adjustments are given for errors by us regarding floral enclosure
cards.
Any cancellation or modification of any order must be received by
Monroe County Flowers.com not later than 48 hours prior to the
scheduled delivery of products. Any cancellation or modification of
any order for products scheduled for delivery on February 14, Easter
Sunday, Mother's Day, Thanksgiving or December 25 must be received
by Monroe County Flowers.com not later than 7 days prior to the
scheduled delivery of products. No returns or exchanges of any
delivered products will be accepted.
It is your responsibility to ensure that all shipping information is
correct when you submit your order. Monroe County Flowers.com takes
no responsibility for any undeliverable or delayed orders due to
incorrect shipping information. Products will be delivered by means
of Monroe County Flowers.com's choosing. It is your responsibility
to ensure that someone is present to accept the order when
delivered, failing which the order will be left in a location at the
discretion of the delivery person, or delivery may be attempted at a
later time, or a notice tag may be left for the recipient to contact
us for delivery of the item. Monroe County Flowers.com takes no
responsibility for any orders that are destroyed, damaged or stolen
as a result of the mode of delivery. Monroe County Flowers.com DOES
NOT GUARANTEE DELIVERY TIMES. We try our best to meet all requested
delivery times, but make no guarantees the flowers will arrive at
any specific time of day.
Provided that Monroe County Flowers.com's care and handling
instructions are followed, Monroe County Flowers.com warrants that
cut flowers will maintain freshness for a period of seven days from
delivery and potted plants will maintain freshness for a period of
fourteen days after delivery. Monroe County Flowers.com will replace
any flowers that lose freshness or potted plants that die within the
warranty period with fresh product of the same or greater value, in
Monroe County Flowers.com 's sole discretion. Warranty claims must
be made within seven days of delivery for fresh flowers or fourteen
days for potted plants by contacting Monroe County Flowers.com at

LIMITATION, IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY AND
FITNESS FOR A PARTICULAR PURPOSE. Monroe County Flowers.com RESERVES
THE RIGHT TO CHANGE ITS WARRANTIES AT ANY TIME, IN ITS SOLE
DISCRETION WITHOUT PRIOR NOTICE WITH RESPECT TO FUTURE SALES AND
DELIVERIES.

oral, between you and Monroe County Flowers.com. In the event of a
conflict between these terms and conditions of sale and any other
documents incorporated by reference or referred to in this
Agreement, these terms and conditions of sale shall govern.
